The seventh amendment was strongly opposed by the anti-Federalists of the period who believed that the government should not establish laws in respect to trial by jury, albeit civil or criminal, guaranteed in the new constitution. On the other hand, Federalists believed that the new congress was within its rights to create laws in civil cases, including trial by jury, believing that if congress had the right to create. In the end, the anti-Federalists won the argument and the seventh amendment was ratified in 1791.

“In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.”
