INFRASTRUCTURE, UKRAINE CONFLICT KEEP LOBBYING REVENUES UP IN Q1: It might be an election year, but business is still brisk for lobbying firms as clients seek to capitalize on the hundreds of billions in funding in last year’s infrastructure bill, navigate the fallout of Russia’s war in Ukraine, and keep track of the latest developments regarding a reconciliation package and China competitiveness bills in Congress.

— “We've never seen three years in a row like this,” Rich Gold, who leads Holland & Knight’s public policy and regulation practice, told PI of the continued pace of business on K Street. “That's pretty crazy.”

— Some in the industry expected lobbying spending to level out ahead of the midterms and after numerous pandemic relief bills and the initial burst that a new administration provides. But between Russia sanctions — an issue on which “which everybody has a dog in the fight” — Democrats’ attempts to rescuistate their climate and spending package, regulatory action, and the House and Senate China bills, “it does not feel like we are slowing down,” Gold said.

— As lawmakers prepare to begin hashing out the difference between the House and Senate China bills over the coming weeks, “almost every industry [or] sector has some interest related to things that are in one bill or the other,” Marc Lampkin, the managing partner of Brownstein’s Washington office, told PI.

— Brownstein’s lobbying revenues were down slightly at the beginning of this year compared with the final months of 2021, but Lampkin said clients remained interested in tapping into the various offerings of the infrastructure bill and monitoring the potential revival of a smaller climate and social spending bill (and its pay-fors) in addition to the China package.

— “As long as it's moving and moving through a traditional conference process, it's going to create lots of opportunities for — lots of need for corporations, trades, etc., to actually have a seat at the table and understand what's going on,” he said, while every whisper of reviving Build Back Better “creates anxiety amongst people around what the tax code may be.”

Muftiah McCartin, the co-chair of Covington & Burling’s public policy practice group, said in a statement that last quarter her firm helped clients “navigate the Administration's implementation of the Bipartisan Infrastructure Bill and Congress's address of national security issues, the pandemic, antitrust, and a myriad of programmatic funding issues across Federal agencies.”

— She added that the firm expects the compromise China legislation to wield “significant impacts on trade and technology manufacturing policy,” while “Democrats will try again to pass a slimmed-down Build Back Better bill that rewires the tax code, addresses rising drug costs, and hastens energy diversification and climate resilience.”

ANOTHER TOP LOBBYING ISSUE: Apple spent more on lobbying in one quarter than it ever has before during the first three months of 2022, as the company seeks to defend against intensifying antitrust scrutiny in Congress,” POLITICO’s Emily Birnbaum reports.

— “Apple, which is known for having a relatively muted federal lobbying presence compared to its Big Tech peers, spent about $2.5 million on lobbying in the first quarter of 2022 — almost doubling the $1.46 million spent during the first quarter of 2021, and rising steadily from the $1.86 million spent in the fourth quarter of 2021.”

— “The increase in spending signals that Apple is devoting serious resources to its escalating fights in Washington. The tech giant has been focused on the antitrust bills in both chambers, including the Open App Markets Act, which would pare back Apple's control over its app store,” and which “passed out of the Senate Judiciary Committee in a 20-2 bipartisan vote.” Apple is also lobbying on the China bills, which would impact a crucial manufacturing partner in Beijing.

CLOSING TIME: “It’s last call at the bar of the Trump International Hotel in Washington,” The New York Times’ Eric Lipton writes, with “the hotel — which for much of President Donald J. Trump ’s four years at the White House served as his dining-out spot, a gathering place for his allies and a bazaar of sorts for those seeking influence and access … slated to be sold in the coming days to a Florida investor group that will take down the Trump name and rebrand it as a Waldorf Astoria.

— “Even before Mr. Trump was sworn in, the hotel became a magnet for foreign officials, including from Saudi Arabia, whose government rented out a block of rooms, spending $190,000 on its room tab and another $78,000 for meals and beverages, lobbying disclosures show. Soon enough, foreign business and government groups from Bahrain, Kuwait, Turkey and Azerbaijan, among others, followed by hosting events at the hotel, with representatives from at least 33 nations sighted there by Zach Everson,” a journalist who tracked its comings and goings.

BINANCE.US LEAVES BLOCKCHAIN ASSOCIATION: Binance.US, the U.S. arm of the world’s largest crypto exchange, won’t renew its membership with the Blockchain Association, one of the industry’s biggest lobbying groups. Instead, it’s opening its own office in Washington as the Biden administration and lawmakers continue to weigh new regulations on the booming digital currencies sector.

— The company’s departure comes just over a year after it joined the Blockchain Association, an addition that prompted the rival exchange Coinbase to withdraw from the organization, and leaves the group’s ranks missing representatives of some of the world’s top exchange platforms by volume, according to Coin Market Cap. (Though Binance is the largest, it was banned from the U.S. and came under scrutiny earlier this year for its business practices. Binance.US operates as a separate legal entity.)

— A source close to the matter told PI that Binance.US had sought a larger role within the Blockchain Association, which spent $900,000 on lobbying last year, but already spent more than half that amount in the first quarter of 2022. Binance.US will now reallocate the resources it would have spent within the Blockchain Association among other industry groups, including the Digital Chamber of Commerce, the source said.

— The Blockchain Association said in a statement that it “wishes Binance.US the best of luck as they build out their operation in Washington” and vowed to “continue to build on its strong track record in 2022 to advance the shared goals of the crypto ecosystem and ensure America remains at the forefront of technological innovation.”
